Hudson man sentenced to probation for not stopping at scene of fatal accidentJuly 10, 2009
A Hudson man was sentenced to probation and community service and ordered to pay $5,000 in fines for failing to stop at the scene of a September accident in Cleveland where a bicycle rider was killed. Cuyahoga County Judge Nancy A. Fuerst on July 9 sentenced Timothy J. Biro, 55, of Hudson to three years probation and 100 hours of community service. She ordered him to pay $5,000 in fines and suspended his driver’s license for three years. Biro can apply for driving privileges after six months. Biro’s attorney was in court Friday and did not immediately return a message. In June, a jury found Biro guilty of failing to stop at an accident, a third degree felony punishable by up to five years in prison. At the time, the judge dismissed a first degree felony charge of aggravated vehicular homicide due to “lack of sufficient evidence of either recklessness or negligence,” according to Ryan Miday, a spokesperson for the Cuyahoga County Prosecutor’s Office. Biro was accused of driving a 2006 Toyota Camry that hit and killed 31-year-old bicycle rider Terrell Jones around 9:10 p.m. Sept. 23 on East 55th Street in Cleveland, according to Cleveland police. Witnesses called 911 and reported the driver of the car did not stop, according to Cleveland Police Lt. Thomas Stacho. Biro told police he thought he hit a chuck hole and didn’t see anything when he looked back in his rear view mirror, according to Stacho.
