COLUMBUS, Ohio (AP) -- A federal judge has tossed out a lawsuit by a Columbus man who was wrongfully arrested on a sex charge and locked up for five days.
Federal Magistrate Judge Mark Abel ruled against 36-year-old Antonio Morales.
He ruled that five days in jail is not a violation of due-process rights and says those involved in the arrest did not purposely cause emotional distress.
Morales tells The Columbus Dispatch (bit.ly/1dawOw) he will appeal the decision because the 2011 arrest hurt his reputation.
Morales sued for false arrest, naming as defendants Franklin County sheriff's deputies and Columbus police.
The attorney representing the officers says they made reasonable efforts to get the suspect's identity correct in a case involving sexual contact with a minor. The real suspect remains at-large.
